By purchasing lesson packages, purchasing or redeeming a gift card, or booking simulator sessions through simudrivelab.com ("Website"), you ("Client") agree to be bound by these Terms and Conditions.

1. Scope of Services

SafeStartDRV provides driving instruction utilizing simulator technology. Clients may purchase prepaid session packages (e.g., 5 or 10-session bundles). Upon purchase, session credits are applied to the Client's account for use within our online scheduling system. Please note that these simulations are for training purposes; no driver's license or learner's permit is required to participate.

2. Minors & Parental Consent

Many of our clients are students under the age of 18. If the Client is a minor, use of the Website and simulator services is expressly conditioned on the review and agreement of a parent or legal guardian. The parent or legal guardian must agree to these Terms on the minor's behalf and assumes responsibility for the minor's compliance with them, including payment for all sessions booked and adherence to the Client Conduct policy below. By providing a parent/guardian email address at registration, purchasing a package or gift card for a minor, or otherwise permitting a minor to book or attend sessions, the parent or legal guardian represents that they have read, understood, and agreed to these Terms in full.

3. Payment Terms

Full payment is required at the time of purchase. Pricing is subject to change at any time without prior notice. Price adjustments will not apply retroactively to sessions already purchased.

4. Session Credits

Each scheduled appointment consumes one session credit. Credits are strictly non-transferable and may only be utilized by the specific individual to whom the account is registered.

5. Scheduling & Availability

All appointments must be managed via the official booking system on the Website. Availability is offered on a first-come, first-served basis. SafeStartDRV does not guarantee specific dates or times and reserves the right to adjust schedules as necessary.

6. Cancellation & Rescheduling

Notice Period: To avoid forfeiture of a credit, the Client must cancel or reschedule at least 24 hours prior to the start time.
Late Cancellations/No-Shows: Cancellations made with less than 24 hours' notice, or failure to attend a scheduled session, will result in the forfeiture of one session credit.
Company Adjustments: SafeStartDRV reserves the right to reschedule any session due to technical malfunctions, maintenance, or unforeseen circumstances. In such cases, no credits will be deducted.

7. Refund Policy

All session package purchases are final and non-refundable. Unused session credits do not expire and remain available on the Client's account for future bookings, but are not eligible for a cash or original-payment-method refund. At SafeStartDRV's sole discretion, courtesy exceptions may be considered for extenuating circumstances (e.g., relocation, medical emergency) — requests can be submitted to info@simudrivelab.com, but approval is not guaranteed.

8. Gift Cards

Gift cards purchased through the Website entitle the recipient to the stated number of simulator session credits once redeemed on the Website using the provided code. Gift cards are non-refundable and cannot be exchanged, in whole or in part, for cash or any other form of payment. It is the purchaser's responsibility to ensure the recipient's email address and details are entered correctly; SafeStartDRV is not responsible for gift cards sent to an incorrect or inaccessible address. Once redeemed, the resulting session credits are subject to the same terms as purchased session packages, including the non-transferable and non-refundable provisions above.

9. Late Arrival

Sessions start promptly at the scheduled time. If a Client arrives late, the session will conclude at the originally scheduled end time to accommodate subsequent bookings. If a Client is more than 15 minutes late, the session may be deemed a "no-show" at the discretion of the staff, and the credit may be forfeited.

10. Communications

By creating an account, you consent to receive transactional notifications, appointment reminders, and service updates via email and SMS text message. You may opt out of promotional communications at any time, though essential appointment notifications will continue.

11. Client Conduct

Clients are expected to treat staff and equipment with respect. Any behavior deemed disruptive, unsafe, or destructive to the simulator hardware may result in the immediate termination of the session and the suspension of future access without refund.

12. Limitation of Liability

SafeStartDRV makes no guarantees regarding the outcome of any state-mandated driving test or the acquisition of driving skills. To the extent permitted by law, SafeStartDRV is not liable for any direct, indirect, or incidental damages arising from the use of our simulator services.

13. Coupons & Promotional Codes

Coupon and promotional discount codes may only be applied to the purchase of a single, individual simulator session at the time of booking or gifting. Coupons cannot be used toward session packages (including 5- or 10-session bundles), any multi-session purchase or gift card, or previously purchased credits, and cannot be combined with other discounts or coupons. Each coupon code may be used once per account unless otherwise stated on the offer. SafeStartDRV reserves the right to modify, restrict, or revoke coupon offers at any time.

14. Governing Law

These terms are governed by the laws of the State of Arkansas. Any disputes arising from these terms shall be resolved in the courts located within Benton County, Arkansas.
